A legal separation is like a divorce where all issues of child custody, support, and property division are resolved just like a divorce. The only real difference is that the parties are still married. This is important for those who for religious or personal reasons do not want to be labeled or stigmatized by being labed as "divorced".
A premarital agreement is an agreement between a man and a woman who are soon to be married that will control spousal support and property division in the event of a divorce. Premarital Agreements are generally used where one member of the couple is significantly wealthier than the other. It may also be used where one member stands to take over a family business. The purpose is to prevent the less wealthy member of the couple to be able to take away one half of the assets of the much richer person if there is a divorce.
A postmarital agreement is similar to a premarital agreement except that it is made after the couple is married.
Domestic violence occurs where one spouse is physically abusive to the other. In this case, the victim can get a restraining order to keep the abusive spouse away for safety reasons. The victim can also seek custody of the children and the right to live in the family residence. Domestic violence cases are psuedo-criminal in nature and often involve the District Attorney's Office.
